Statutory accommodation: your legal requirements for registration
If you use a prescribed term, you are required to register with Fáilte Ireland and meet the relevant quality assurance criteria before operating. This section explains your statutory obligations and how to complete registration.
About statutory accommodation
If your business uses any of the prescribed terms set out in the Tourist Traffic Acts, you are required by law to register with Fáilte Ireland and meet the relevant quality assurance criteria. Following registration, your business will be required to renew its registration each year.
Common prescribed terms include:
- Hotel
- Guesthouse
- Hostel (holiday and youth)
- Caravan and camping
- Registered self-catering
- Holiday camp
Fáilte Ireland sets out prescribed terms for statutory accommodation, including but not limited to those listed below.
Operating without registration, or advertising using a prescribed term, is not permitted under Tourist Traffic Acts. This may include restrictions on certain licences, such as a hotel liquor licence.

Before you apply
Before starting your application, make sure you have the required documentation available, such as:
- Valid planning permissions
- Compliance reports for planning and building
- Fire safety certificate
- Food safety compliance (where applicable)
- Public liability insurance
Fees
Registration fees vary by sector. You can review the relevant fee for your accommodation business in the Fee schedule.
Inspection / Assessment
An on-site inspection / assessment is required as part of registration. An Inspector / Quality Assurance Advisor will assess your accommodation against prescribed regulations and relevant classification criteria. You will be contacted to arrange a date after your application is submitted.
You may be given follow-up actions to complete within an agreed timeframe.

Most applications are completed within a number of months, pending receipt of documentation.
