Fáilte Ireland usage rights for your image: General terms of service

To make sure, you are happy for us to use your photo and video content with the appropriate rights on our websites, social channels, and various promotional materials.

First you should understand that Discover Ireland is a sub brand of Fáilte Ireland which is the National Tourism Development Authority of Ireland.

Fáilte Ireland owns and operates the consumer tourism sub-brands and websites DiscoverIreland.ie which includes Ireland’s Ancient East, Ireland’s Hidden Heartlands and Wild Atlantic Way and Visit Dublin.
 
By responding to our message request with the Hashtag you represent and warrant that:

• you are an individual eighteen (18) years of age or older;
• you own all rights in and to your photos and they are not copied from any third parties;
• you have permission from any adult(s) appearing in your photos to grant the rights herein;
• you have permission of parent/legal guardian where minors who have not yet reached the age of 16 may be featured;
• you waive (or if waiver is not permissible by law, will not assert) any moral rights or other rights with respect to authorship or integrity of the photos.
• that you have read and that you agree to the following terms and conditions set out below.

By responding to our request message with one of our Hashtags, you grant us permission to use your photo or videos in Fáilte Ireland content as follows: 

You grant Fáilte Ireland a non-exclusive, unlimited, royalty free worldwide license to reproduce, display, perform, distribute, archive, edit, adapt, modify and otherwise use any photo or video content posted or tagged in the comments with the Hashtag. 

This means by responding with one of Hashtags to our request message or posting content with the Hashtag, you assign Fáilte Ireland and its sub-brands the right to use the photos or videos in its marketing and/or advertising.

For example, your photos could be used on our social media channels, on our websites in a photo gallery, in email newsletters, printed materials, used at Fáilte Ireland touch points; in tourist information centres, at event activations, or in internal communications, or used on outdoor billboards and posters, and in online video and television advertising.

We may exercise our rights anywhere in the world, and the consent granted by will be Adults = 7 years or until the individual withdraws their consent (whichever occurs first). Children (under the age of 16) = 5 years or until the individual withdraws their consent (whichever occurs first). You waive the right to inspect or approve the final usage of the image within advertising copy, text or any other advertising and marketing material. However, Fáilte Ireland shall have no obligation to use your photo. Fáilte Ireland may use UGC assets for paid advertising in certain instances where the asset has received a high number of social engagements in a previous organic post. This is in order to further increase reach and engagement of the asset and post. The original creator will be credited for each use of their photo or video.

Your photos may be viewed not only by you, but also by other fans of Fáilte Ireland brands around the world. You have the opportunity to inspire others with your own self-expression and creativity.

Fáilte Ireland may, in its sole discretion, include your social handle or byline when using your photos. Our license is non-exclusive, meaning you can still use your photos and videos for your own purposes and let others use them for their purposes too. In return you release and discharge Fáilte Ireland from all and any obligation to pay you in connection to our use of your photos as described above and any of the intellectual property rights contained therein when you respond with one of our Hashtags.

We respect your privacy and we value the trust you have put in us.

In reaching out to you about your photos, we necessarily process your social media username. We only use this personal information for the purposes described above.

We are committed to keeping your personal information safe. We've got physical, technical and administrative measures in place to prevent unauthorised access or use of your information.
